Ballot Conditions
A. INTRODUCTION

1. Scope
Due to the expected demand for tickets for the DHL NZ Lions Series, the NZRU is running a weighted public ballot for Tickets for the DHL NZ Lions Series 2005 ("Ballot"). Entry and participation in the Ballot is subject to the following terms and conditions ("Ballot Terms and Conditions"), which are designed to ensure that a fair and transparent system for the issue of Tickets for the Lions Series 2005.

2. Definitions

Application Form: means the official application form issued by the NZRU for the Ballot, available at www.lions.co.nz or through NZ Post Shops.
Child: means an individual under 16 years of age.
Child Ticket: means a Ticket to a Provincial Match which will admit entry for a Child (as at the date of the Match) to that Match.
Lions Tour 2005: means the 2005 British and Irish Lions Tour of New Zealand currently scheduled for the period 4 June 2005 to 9 July 2005.
Match: means a match played as part of the Lions Tour 2005.
Ticket(s): means ticket(s) giving a right of entrance to a particular Match.
Notify/Notification: means the telephone discussion between the NZRU's official ticketing agent for the Lions Tour 2005 and a successful Applicant (or where the successful Applicant is a Child, the parent or guardian of that Child as nominated on the successful Applicant's Application Form), where that successful Applicant is advised they have been allocated Tickets under the Ballot but does not include any message which may be left by NZRU's official ticketing agent.
Provincial Match(es): means a match to be played as part of Lions Tour 2005 which is not a "Test Match" between the All Blacks and the Lions team nor the "NZ Maori Match" between the New Zealand Maori team and the Lions team.


B. THE APPLICATION PROCESS

3.1 Application Forms will only be accepted for entry in the Ballot between 9 am 1 November 2004 to 5pm 24 December 2004, New Zealand local time ("Registration Period"). Application Forms received before or after the Registration Period will not be considered for entry in the Ballot.

3.2 The Ballot may be entered only by:
(a) an individual whose usual place of residence is in New Zealand and who is not a Child; or
(b) a Child whose usual place of residence is in New Zealand, who is a Rugby Community Member.
Companies may not enter the Ballot. Application Forms received from anyone who does not meet the above eligibility criteria will be rejected and will not be entered in the Ballot.

3.3 Only fully completed Application Forms meeting the eligibility criteria will be accepted and entered into the Ballot. All fields on the Application Form indicated as mandatory fields must be completed. Any Application Form received with insufficient postage, which is incomplete, unclear or damaged will be rejected. Applicants are responsible for ensuring all information recorded in their Application Forms are accurate and correct.

3.4 Only one Application Form submitted per individual ("Applicant") will be entered into the Ballot. If an Applicant submits more than one Application Form then only the first eligible Application Form received from that Applicant will be entered into the Ballot and all other Application Forms from that Applicant will be disregarded.

3.5 Applicants can request a maximum of 2 Tickets to each Test Match and a maximum of 4 Tickets to each Provincial Match. If more than the maximum number of Tickets are specified for any Match, then the Application Form may be rejected. Applicants can specify only one price category for all Test Match preferences and only one price category for all Provincial Match preferences.

3.6 Applicants who provide an email address on their online Application Form will, if practicable, be sent confirmation by email that their Application Form has been received and entered in the Ballot. This email confirmation should also include an allocated Ballot PIN number. Applicants with a Ballot PIN will be able to change their Match preferences up until 5pm 24 December 2004 and their personal details up until the ballot runs on Wednesday 9 February, 2005. Applicants issued with a Ballot PIN number are responsible for all use of that Ballot PIN and are advised not to disclose their Ballot PIN. Applicants who submit a paper application form or do not supply an email address with their online form will not be notified of receipt of their application form.

3.7 NZRU will not be liable for any incorrect entry of information, technical malfunctions of the Internet, failure of computer hardware or software, or lost, incomplete or illegible Application Forms, nor Applications Forms where the contact details are not up to date.



C. AVAILABILITY AND WEIGHTING OF APPLICATIONS

4.1 Only a portion of Tickets to the Matches are included in the Ballot, as NZRU is obliged to make Tickets available to particular people or groups. The "Ballot Pool" means the pool of Tickets to Matches available for allocation under the Ballot. The NZRU reserves the right to change the number of Tickets (including, without limitation, the price categories and Ticket types) in the Ballot Pool for any particular Match.

4.2 Child Tickets and Tickets for wheelchair seating within the Ballot Pool are limited. Child Tickets and wheelchair seating will be allocated to Applicants successful in the Ballot in the order they are drawn. If all available Child Tickets or wheelchair seating to a particular Match has already been allocated, a successful Applicant seeking Child Tickets or wheelchair seating will be offered general Tickets at full adult prices.

5.1 Applicants will receive a "weighted" entry in the Ballot (which will impact on the Applicant's chance of their entry being successful in the Ballot) as follows:

  Test Match & NZ Maori Match Weighting:
  Applicants who are not Rugby Community Members or Season Pass Holders

  Applicants who are Rugby Community Members or Season Pass Holders
 
2 Chances
 
  Provincial Match Weighting:
  Applicants who are not Rugby Community Members or Season Pass Holders and who reside outside the Match Province
 
1 Chance
 
  Applicants who are not Rugby Community Members or Season Pass Holders and who reside within the Match Province
 
2 Chances
  Rugby Community Members and Season Pass Holders who reside outside the Match Province
 
3 Chances
  Rugby Community Members and Season Pass Holders who reside within the Match Province
 
4 Chances

5.2 For the purposes of the above weightings:
"Rugby Community Members" are Applicants who have been supplied with, by the NZRU (and who include in their Application Form), a valid Rugby Community Member Number.
"Season Pass Holders" are Applicants who have been supplied with, by the NZRU (and who include in their Application Form), a valid Season Pass PIN.
"Match Province" means, in relation to the provincial union hosting that Match, the geographical boundaries of that provincial union, except that:
  • the Match Province for the Auckland Provincial Match will be deemed to include the geographical boundaries of the Counties Manukau and North Harbour provincial unions; and
  • the game province for the Wellington Provincial Match will be deemed to include the geographical boundaries of the Horowhenua-Kapiti provincial union,
in each case, as defined by the rules/regulations governing the Air New Zealand NPC.
Whether or not an Applicant resides within or outside the Match Province for a Match will be determined on the basis of the residential street address specified on the Applicant's Application Form.


D. THE BALLOT PROCESS

6.1 If, after the Registration Period closes, demand exceeds supply for a particular Match, (including any one price category for that Match or seating category for the Match), all Tickets for that Match and/or category will be allocated by way of weighted Ballot in accordance with the weighting as shown above. If demand does not exceed supply for that particular Match or price category or seating for that Match, each Applicant entered into the Ballot will be successful and NZRU's official ticketing agent will attempt to Notify them in due course.

6.2 6.2 The Ballot will be drawn on Wednesday, 9 February 2005. All Applicants entered in the Ballot will be automatically drawn, and allocated a ranking, by a fully automated process. The NZRU's official ticketing agent will attempt to provide Notification to each Applicant whose ranking qualifies them for allocation of Tickets from the Ballot Pool, between Monday 14 February 2005 and Friday, 1 April 2005. Once Notification takes place, the successful Applicant can accept the allocation as set out below.

6.3 NZRU does not guarantee successful Applicants will be allocated Tickets in their nominated price category, seating category, seated together, or Tickets to their nominated Match. The Ticket(s) allocated to successful Applicants in the Ballot is final. Successful Applicants will not be able to substitute allocated Ticket(s) for other seats at the Match or substitute allocated Tickets for seats at other Matches and will not be offered any additional Tickets in the Ballot. The Ballot allocation and draw is final and no correspondence will be entered into.

6.4 When a successful Applicant has been Notified, the Applicant must either accept or reject the offer of Tickets at the time of Notification. An Applicant may refuse any or all Ticket(s) offered to them.

6.5 Applicants who accept all or some of the Ticket(s) offered to them, acknowledge and agree that they are offered subject to the full Ticket Terms and Conditions and that they must comply with the Ticket Terms and Conditions.

6.6 An Applicant accepting any of the Ticket(s) offered must pay for the Ticket(s) and the $15.00 booking fee (which includes a courier charge) within 48 hours of being Notified. Payment can be made over the phone at the time of Notification by credit card (in the name of the Applicant, or where the Applicant is a Child, the Applicant's nominated parent or guardian as recorded on that Applicant's Application Form) or within 48 hours of Notification at any NZ Post Shop (by cash, EFTPOS or by credit card using NZ Post BillPay). BillPay payments will attract an additional $2.00 surcharge.

6.7 A successful Applicant's allocation will be deemed returned to the Ballot Pool (without the applicant being informed):
  • if the NZRU's official ticketing agent is unable to Notify a successful Applicant on the preferred contact telephone number provided by the successful Applicant;
  • to the extent that the successful Applicant rejects some or all of the offer of Tickets at the time of Notification; or
  • if the successful Applicant fails to make payment for the Tickets within the time periods set out herein.
In the event that the Applicant's allocation of Tickets is deemed to be returned, the returned Tickets will be returned to the Ballot Pool and allocated to the highest-ranking Applicant whose Ticket preferences match the returned Ticket(s), who is yet to be allocated any Tickets. This process will continue until all of the Tickets are all allocated or until contact has been attempted with all successful Applicants as noted above.

6.8 If any Ballot Pool Tickets to a particular Match or Matches are still available after all allocations of Tickets for such Matches either being accepted or returned, then the NZRU will announce this and how the public can purchase Tickets to such Matches in due course.


E. ISSUE OF TICKETS

7.1 Only Tickets paid for in full (including fees as set out above) within 48 hours of Notification will be issued to successful Applicants and delivered by courier to the successful Applicants at the street address specified in the relevant Applicant's Application Form.

7.2 All issuance of Tickets is final and non-refundable. NZRU will not replace Tickets if they are lost, stolen, forgotten, damaged, forged or unreadable.


F. GENERAL

8 Applicants acknowledge and agree that the personal information provided by Applicants in their completed Application Forms will be entered into an NZRU database for use in connection with the conduct of the Ballot, any relevant safety and security measures in relation to the Matches compliance with law and to enforce these Ballot Terms and Conditions and the Ticket Terms and Conditions. Applicants also agree that the personal information supplied by them may be retained by the NZRU to be used in the future to provide Applicants with information on events or products and services of NZRU provincial unions and other affiliated members of the NZRU or companies selected by NZRU. Applicants will be able to access and update their personal information by contacting the NZRU. Applicants may also request to be removed from the NZRU database by contacting the NZRU.

9 In the event that any provision(s) of these Conditions be declared void, ineffective or unenforceable by any competent court, the remainder of these Conditions will remain in effect as if such void, ineffective or unenforceable provision(s) had not been included.

10 NZRU reserves the right to make amendments to these Ballot Terms and Conditions from time to time. Applicants are responsible for checking the Ballot Terms and Conditions on a regular basis to review any amendments which will be available at www.allblacks.com and www.lions.co.nz and, upon request, from NZRU, at the address set out in the Ticket Terms and Conditions. Applicant's continued participation in the Ballot indicates acceptance of any amendments.

11 These Conditions will be governed by and interpreted in accordance with the laws of New Zealand. All disputes arising from or related to these Conditions will be submitted to the competent Court in New Zealand. Nevertheless, the NZRU reserves the right to pursue any legal proceeding in the competent courts at the defendant's domicile.
