New Zealand Rugby Commercial User Generated Content Consent
These terms and conditions set out how New Zealand Rugby Commercial LP (NZRC, we, us or our) can use, publish, reproduce, modify, distribute or otherwise deal with any User Generated Content submitted to NZRC along with your and NZRC’s rights and obligations related to User Generated Content.
User Generated Content means any image, photo, video, text, graphics or any other content you have submitted or published on social media platforms. By submitting or publishing User Generated Content and/or agreeing to our request to use User Generated Content, you agree to these terms and conditions. These terms and conditions may be amended by NZRC by publishing an updated version on this website with any updated version applying to your User Generated Content.
You represent and warrant that:
- You are at least 18 years of age or if you are under 18 years of age, you have obtained your parent or legal guardian’s permission to submit the User Generated Content and to agree to these terms and conditions.
- The User Generated Content is your own creation and/or you own or control all rights in, and have the necessary rights to, the User Generated Content (including consents from third parties or other people in the User Generated Content or parent or guardian of anyone in the User Generated Content under 18 years of age).
- The User Generated Content does not infringe or violate the rights of any third parties, including intellectual property rights, copyright, trademarks, rights of publicity or privacy, patent, trade secret or confidentiality rights.
- The User Generated Content does not contain any content or otherwise that could be considered inappropriate, unsuitable, threatening, obscene, abusive, hateful offensive, illegal, unlawful or otherwise.
- To the best of your knowledge and belief, you are in good mental and physical health and have no medical or psychological or other condition which could affect of prevent your understanding and acceptance of these terms and conditions.
- The User Generated Content complies with all applicable laws and regulations.
You acknowledge that NZRC has the sole discretion to determine whether User Generated Content contravenes the above representations and warranties or breaches these terms and conditions. We may remove any User Generated Content in our sole discretion for whatever reason at any time without notice or take any other action as deemed necessary by NZRC (for example, blocking your access to our websites).
By submitting or publishing User Generated Content, you grant NZRC a perpetual, worldwide, non-exclusive, sublicensable, irrevocable, fully transferable licence to use, publish, modify, distribute or otherwise deal with the User Generated Content in any form, for whatever purpose (including commercial) and on any media or otherwise. This means that our right to possess, use and display the User Generated Content anywhere and through any means will never expire and that we may allow others to use or possess the User Generated Content. If you remove the User Generated Content or would prefer that NZRC no longer use it, please contact us at [email protected] and we will work to address your request.
Unless otherwise agreed, you acknowledge and agree that the use of User Generated Content is without compensation or payment. Use of User Generated Content is at our sole discretion and we have no obligation to use or feature your User Generated Content.
You also grant us the right to publish your social profile information or other information you have submitted in connection with any use of your User Generated Content, including but not limited to your name, username, profile picture, likeness, original caption, biographical information and region. In addition, you also acknowledge and agree that your personal information will be subject to the NZRC privacy policy.
NZRC takes no responsibility for any of the User Generated Content. To the fullest extent permissible under applicable law, NZRC nor any of its officers, directors, employees, contractors, agents or otherwise are not liable for any direct, indirect, incidental, consequential, special, punitive, similar or any other damages, costs, claims, expenses or liabilities arising out of, or resulting from, use of the User Generated Content or these terms and conditions, including (without limitation) damages for harm to business, lost profits, lost savings, lost revenues or otherwise, however such damages are caused and whether based in contract, tort (including negligence) or any other legal theory of liability. The foregoing limitations apply regardless of whether you have been advised of the possibility of such injury, damages, losses or expenses or whether or not they were reasonably foreseeable. You also agree that you will not bring any claim against NZRC or any of its subsidiaries or affiliates.
The use of User Generated Content is in no way sponsored, endorsed, administered by or associated with any social platforms including Facebook, Twitter, Snapchat or Instagram. Nor does it imply any endorsement or affiliation with you whatsoever.
These terms and conditions are governed by New Zealand Law.
